Background<\/strong><\/strong><\/p>\n\n\n\n

On December 27, 2023, the Commission on Journalistic Ethics received a complaint from the head of the High Qualification Commission of Judges of Ukraine Roman Ihnatov regarding a story by journalist of TSN online outlet Artem Ziabkin \u201cSCANDAL AGAIN! Ukrainian TOP Official Turns Out Citizen of Russia?!\u201d <\/strong>of December 21, 2023, available at  https:\/\/www.youtube.com\/watch?v=TQxXV5zVOew<\/a>. The text version of the story, penned by Svitlana Neschetna, is available on the TSN website at https:\/\/tsn.ua\/exclusive\/znovu-skandal-ukrayinskiy-topchinovnik-viyavivsya-gromadyaninom-rosiyi-video-2476645.html<\/a>.<\/p>\n\n\n\n

The story covers the complainant, who is the head of one of Ukraine\u2019s key agencies within the judicial reform, possibly having a Russian passport. It relies on data published in the material by Dzerkalo Tyzhnia citing a letter by the SBU and sources in the judiciary. The video material quotes the original material by voicing and demonstrating statements published by Dzerkalo Tyzhnia, as well as the complainant\u2019s statements in Sudovo-Yurydy\u0441hna Hazeta. The story does make it clear what materials are being cited, though links to them are not published in the text version of the story. The story ends by comparing the complainant\u2019s situation with that of Bohdan Lvov, who concealed his Russian citizenship working as a judge at the highest levels in the judiciary, including the Supreme Court.<\/p>\n\n\n\n

The story is also accompanied by section titles such as “Where were the law enforcement officers?!” (1:23-1:27); “Mole in judicial reform?\u201d (2:57-3:02); “It’s never happened before, and here it is again!” (4:15-4:21). The YouTube caption says: \u201cScandal in the High Qualification Commission of Judges!The media found that the head of an ultra-important government institution Roman Inhatov is a Russian citizen!They say the SBU found the judge\u2019s red passport!Watch the exclusive TSN.ua story covering what we know about this incident, how Ihnatov was allowed to work for Ukraine for years, and why everyone stayed silent!\u201d<\/p>\n\n\n\n

The complainant believes that the style of information presentation and the editing of the video are meant to create a clear impression that he has the Russian citizenship. In his opinion, despite the presentation of his explanations and third-party information about his integrity in the plot, the material creates a biased attitude towards him and asserts that he has Russian citizenship as an established fact. He also emphasizes that although the debunking was published separately by the online media outlet, information about it was not added as a footnote to the already published story and was not covered in a separate video. In his opinion, this indicates a violation of the requirements of clauses 6, 8 and 9 of the Ethics Code of the Ukrainian Journalist.<\/p>\n\n\n\n

On January 11, 2024, the Commission requested the online media to provide comments about the possible violations in its material. No response was provided.<\/p>\n\n\n\n

Relevant ethical standards<\/strong><\/strong><\/p>\n\n\n\n

Clause 6 of the Ethics Code of the Ukrainian Journalist: \u201cRespecting the right of the public to full and objective information about facts and events is the primary duty of a journalist. Journalists and editors must take steps to verify the authenticity of all messages, video and audio materials received from members of the public, freelancers, press services and other sources.\u201d<\/em><\/p>\n\n\n\n

Clause 8 of the Ethics Code of the Ukrainian Journalist says: \u201cEditorial processing of materials, including pictures, texts, headlines, the consistency of the video sequence and the text commentary etc. should not falsify the content. The audience should be informed about presenting rehearsed or reconstructed news.\u201d<\/em><\/p>\n\n\n\n

Clause 9 of the Ethics Code of the Ukrainian Journalist: \u201cFacts, judgments and assumptions must be clearly separated from one another. The dissemination of information containing bias or unfounded accusations is unacceptable.\u201d<\/em><\/p>\n\n\n\n

Regarding violations of the requirements of the Code, cl. 6<\/strong><\/strong><\/p>\n\n\n\n

The reliability of information provided, which must be ensured by all journalists as per the Ethics Code, requires due verification of all sources used in the material. The material must contain references to external materials used, including expert reports, materials from other media, as well as an indication of sources that are not disclosed for various reasons (threats to source security, whistleblowers, insiders, etc.).<\/p>\n\n\n\n

In the story in question, which is primary in relation to the text version of the material, there are references to Dzerkalo Tyzhnia and screenshots of quotes shared from their material. It also mentions the article in the \u201cSudovo-Yurydychna hazeta,\u201d which expresses the complainant\u2019s position regarding his experience of working in the Russian Federation. The Commission is aware that the format of the video materials does not allow placing links to external materials, and therefore, in the current situation, TSN made every effort to direct the consumer of information to the desired source of information. At the same time, the text format allows the use of links, and despite referencing Dzerkalo Tyzhnia\u2019s website, TSN representatives failed to provide the link to the original material. Therefore, the Commission concludes that the text version of the story, written by Svitlana Neschetna, fails to adhere to the requirements regarding veracity of the information provided.<\/p>\n\n\n\n

Regarding violations of the requirements of the Code, cl. 9<\/strong><\/strong><\/p>\n\n\n\n

The standard of distinguishing facts from assumptions is important when preparing analytical materials and covering situations where part of the facts are not reliably established. Journalists must clearly indicate what parts are facts and which ones are their own opinions or conclusions about the situation so that the consumer of information can independently come to certain conclusions. This should also serve as a safeguard against biased attitude to the heroes of the materials.<\/p>\n\n\n\n

TSN\u2019s story uses a vivid linguistic style, which, however, mostly remains in line with clause 9 of the Ethics Code of the Ukrainian Journalist. Each statement about Roman Ihnatov possibly having the Russian citizenship is either based on Dzerkalo Tyzhnia\u2019s material or its citation, or it is presented in the form of a question or clear allegations, such as \u201cThis is not the first time that rumors about Ihnatov\u2019s Russian citizenship have emerged.\u201d The media also presents the position of the complainant himself, taken from his interview.<\/p>\n\n\n\n

An exception to this is the first statement that Artem Ziabkin uses to start his story: \u201cThe head of a highly important Ukrainian judicial agency Roman Ihnatov turned out to be a Russian citizen.\u201d It is phrased as a statement, even though the complainant having an aggressor passport is not a legally established fact, as it is further covered in the story. By doing this, the journalist and the media create a biased attitude to Roman Ihnatov with the information consumers. Even though, being a high-ranking civil servant, the complainant must be able to tolerate criticism, Artem Ziabkin\u2019s words refer to unproven allegations and thus cross the line of permissible criticism. In view of this, the Commission concludes that there are violations of the requirements of clause 9 of the Code in the story.<\/p>\n\n\n\n

Regarding violations of the requirements of the Code, cl. 8<\/strong><\/strong><\/p>\n\n\n\n

Clause 8 of the Code primarily serves as a safeguard against such phenomena as clickbait, which can lead the consumer to form an attitude towards a certain material even before reading \/ viewing it (and sometimes, instead). This can distort the content on the material in favor of sensationalism, confirmation bias or affirmation of stereotypes, which can often be done by the media with a political goal or to gain benefit from certain actors.<\/p>\n\n\n\n

The story at issue in this case abuses the sensationalism of section titles in the story itself, the title and the caption under the video. The presentation of the material essentially further leads the information consumer to create a bias against the complainant by using rhetorical questions, a large font, interrobangs, uncharacteristic of the information style, etc. The emotional coverage of such content helps boost the audience but contradicts the ethical principles, as it prevents the audience from perceiving an alternative viewpoint. Even if, in order to achieve a balanced presentation of information, the opinion of the other side of the conflict is presented in the material, as is done in the case under consideration, the consumer of information will may be reluctant to perceive it due to the pre-established emotional attitude. The actions of journalists and TSN in this case indicate that they violated the requirements of clause 8 of the Code.<\/p>\n\n\n\n

Conclusion and recommendations<\/strong><\/strong><\/p>\n\n\n\n

In view of the above, the Commission believes that the story of TSN journalist Artem Ziabkin \u201cSCANDAL AGAIN! Ukrainian TOP Official Turns Out Citizen of Russia?!\u201d as of December 21, 2023, violates the requirements of clauses 8 and 9 of the Ethics Code of the Ukrainian Journalist, and its text version by Svitlana Neschetna violates clauses 6 and 8 of the Code. The Commission thus issues a warning to the journalists.<\/p>\n\n\n\n

The Commission recommends that the media carefully distinguish between facts, assumptions, and judgments in materials of significant public interest, and avoid using stylistically colored vocabulary and uncharacteristic tropes, fonts and emoticons to embellish such materials.
