{"id":8064,"date":"2023-11-30T17:19:56","date_gmt":"2023-11-30T15:19:56","guid":{"rendered":"https:\/\/cje.org.ua\/?post_type=news&#038;p=8064"},"modified":"2023-11-30T17:19:57","modified_gmt":"2023-11-30T15:19:57","slug":"regarding-the-investigation-into-the-issuance-of-border-crossing-permits-by-lviv-oblast-military-administration","status":"publish","type":"news","link":"https:\/\/cje.org.ua\/en\/news\/regarding-the-investigation-into-the-issuance-of-border-crossing-permits-by-lviv-oblast-military-administration\/","title":{"rendered":"Regarding the investigation into the issuance of border crossing permits by Lviv oblast military administration"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Background<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On June 21, 2023, the Commission for Journalistic Ethics received a complaint from Oleksii Shevchuk about the material by Censor online outlet<strong> \u201cLviv Oblast Military Administration has issued hundreds of border crossing permits to \u201cvolunteers\u201d associated with lawyer Shevchuk \u2014 media. Infographic\u201d <\/strong>published on June 6, 2023, available at: <a href=\"https:\/\/censor.net\/ua\/news\/3422982\/lvivska_ova_vydala_sotni_dozvoliv_na_vyyizd_volonteram_povyazanym_iz_advokatom_shevchukom_zmi_infografika\">https:\/\/censor.net\/ua\/news\/3422982\/lvivska_ova_vydala_sotni_dozvoliv_na_vyyizd_volonteram_povyazanym_iz_advokatom_shevchukom_zmi_infografika<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The material published by Censor is a reprint of parts of the investigation <a href=\"https:\/\/ngl.media\/2023\/05\/31\/kvytky-v-odyn-bik\/\">\u201cOne Way Ticket\u201d<\/a> published by another online outlet, Nashi Hroshi.Lviv (now NGL Media), on May 31, 2023. The story covers abuses committed by Lviv oblast military administration on entering volunteers into the Sliakh system and how a number of little-known civil society organizations are involved in the scheme. A significant part of these organizations has a certain connection with the applicant \u2014 business relations or links as part of Oleksii Shevchuk\u2019s law business.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The applicant believes that the information in the material is presented in a one-sided, biased manner, by selectively presenting facts and distorting them. The article did not indicate that the applicant was not a member of any commission that made a decision on issuing a permit to cross the border. He claims that he has no relation to the vast majority of organizations listed in the investigation, and that journalists refused to meet with him. He also claims that he published an article on CensorNet.Blogs, where he tried to express his opinion on the issue, but it was removed, and the login and password combination to access the website was allegedly changed. In view of this, the applicant believes that the journalist violated the requirements of clauses 2, 6, 10, 12 and 19 of the Ethics Code of the Ukrainian Journalist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On August 21, 2023, the Commission asked Censor to provide commentary on the material and on the reasoning provided in the complaint. In his response, provided on August 28, 2023, the editor-in-chief of the media, Yurii Butusov, said that Censor published this material because it considers the information relevant and socially important, and that when publishing it, the journalists provided a link to the original source of information. He also claims that the original material relied on by the Censor newsroom contains proper information and evidence for the statements expressed in the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As part of the preliminary remarks, the Commission must indicate that it will not consider the case in terms of violation of clause 19 of the Ethics Code of the Ukrainian Journalist, which is a procedural item asserting the Commission\u2019s competence to consider cases related to violations of journalistic ethics standards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Relevant ethical standards<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clause 2 of the Ethics Code of the Ukrainian Journalist: <em>\u201cServing the interests of the authorities or the founders rather than society is a violation of journalistic ethics.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clause 6 of the Ethics Code of the Ukrainian Journalist: <em>\u201cRespecting the right of the public to full and objective information about facts and events is the primary duty of a journalist. Journalists and editors must take steps to verify the authenticity of all messages, video and audio materials received from members of the public, freelancers, press services and other sources.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clause 10 of the Ethics Code of the Ukrainian Journalist: <em>\u201cViews of the opponents, including ones who are objects of journalistic criticism, must be presented in a balanced manner. Assessments of independent experts must be provided the same way.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clause 12 of the Code of Ethics of a Ukrainian Journalist: <em>&#8220;A journalist is obliged to do everything possible to correct any disseminated information if it turns out to be untrue.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clause 19 of the Code of Ethics of a Ukrainian Journalist: <em>&#8220;Deliberate violation of the norms of journalistic ethics is absolutely incompatible with professional journalism, is subject to public condemnation, and may be grounds for deprivation of a press card or membership in professional unions and National Union of Journalists of Ukraine. Consideration of conflict situations of an ethical and professional nature is carried out by the Commission on Journalistic Ethics.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Regarding violations of the requirements of the Code, cl. 6<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Compliance with the requirements of clause 6 of the Ethics Code requires that the media and the journalist verify the authenticity of all the facts provided in the material. If a material by another media outlet is reprinted or used, the outlet must provide a proper link to the original source, enabling the consumer to verify the provided information independently. In cases of such reprinting or processing, the media that shares previously published information must take into account the observance of the standards of journalistic ethics in the original material, since the reproduction of low-quality materials can lead to amplification and increase in the harmful impact of the original publication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The material under consideration contains a proper link to the original material of Nashi Hroshi. Lviv and cites its main conclusions, also providing an infographic. In the opinion of the Commission, a reference to the original publication and a confirmation by the editor-in-chief that the editors checked the original material (on which Censor relied) for the presence of appropriate information and evidence for the statements expressed in the investigation can be considered sufficient efforts for a decision on publication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In view of this, the Commission believes that Censor complied with clause 6 of the Code while reprinting the material by Nashi Hroshi. Lviv.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Regarding violations of the requirements of the Code, cl. 10<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The standard of balanced presentation of information requires media representatives to highlight the position of different parties to the conflict in the material. This is necessary in order to provide the audience with the opportunity to fully evaluate opposing views and avoid one-sided presentation of the material. If the object of criticism within the material did not provide their position or directly refused to provide comments under a certain pretext, then this should be indicated in the material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The original publication indicated that <em>\u201cShevchuk refused to talk, saying he was unsure that he talked to journalists and not fraudsters.\u201d&nbsp;<\/em>The applicant&#8217;s refusal to communicate with journalists regarding the contentious issue was also reproduced when the material was shared by Censor: <em>\u201cLviv Oblast Military Administration and lawyer Oleksii Shevchuk refused to communicate with the journalists\u201d<\/em> is what the material says.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Responding to the Commission\u2019s inquiry, editor-in-chief of Censor Yurii Butusov points out: \u201cWe published the investigation by the colleagues from Nashi Hroshi. Lviv on our website because we consider it relevant and socially important. When publishing the material, even in the headline, we indicated the source of the statement \u2014 \u2018media\u2019 \u2014 and the news item itself referred to Nashi Hroshi. Lviv as the source of information. And that is why we believe that the applicant&#8217;s accusations against us regarding the publication of the aforementioned information and facts are inadequate, because we shared the opinion and findings of our colleagues from Nashi Hroshi. Lviv. In addition, the material by Nashi Hroshi. Lviv to which we referred while publishing the news item indicated that the newsroom gained access to a data set with Lviv Oblast Military Administration orders about entries into the Shliakh system. Such statements are mostly justifiable grounds for publishing materials prepared on their basis.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the indicated situation and considering the statutory exemption of media from liability for reprinting materials from other media, the Commission does not view this as a violation of clause 10 of the Code. However, the Commission draws the attention of newsrooms and journalists to an important point connected with the due work with reprints.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the reprint is done within a reasonable period, and the individual in the story previously refused to comment on the claims, the media reprinting the story is not necessarily obliged to approach the individual for a comment again. However, the media remains obliged to give the person subject to criticism the right to respond if it receives such a request. Therefore, due procedure in working with reprints is an essential aspect of working with materials which are taken from other sources, rather than arise from the creative work of the journalist themselves, even with the use of materials from other sources.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Regarding violations of other requirements of the Code<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Commission does not have sufficient grounds to believe that the material is aimed at serving the interests of the authorities or the owners of certain media contrary to the requirements of paragraph 2 of the Code: it raises the socially important topic of questioning the legality of men going abroad during martial law. The applicant himself refused to comment on the original publication or provide his opinion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Clause 12 of the Code does indeed provide for procedural requirements for correcting information in the event that it proves to be inaccurate. Given the nature of the provision, the Commission is not going to evaluate the material for violations, since it does not have any proof about any appeal to the media in this regard, nor does it see any inaccurate information in the material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We should also consider the episode connected with restricting the applicant\u2019s access to his blog on CensorNet.Blogs platform, where he had a (short-lived) opportunity to respond to critical statements mentioned in the original investigation and the reprint. In situations similar to the one at hand, the opportunity to respond via a public blog can serve as an appropriate way to balance the position expressed in critical stories or investigations, and should be taken into account when assessing whether the media has met the standard of balanced reporting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Commission does not have sufficient information to conclude whether the access to the platform was deliberately limited by the blogging service administration and whether such a limitation was connected with the material considered as part of this complaint. Access to blogs can often be restricted due to violations of platform rules, such as using obscene language, inciting hatred in texts or comments, and it may be a legitimate decision. However, as the Commission noted in its <a href=\"https:\/\/cje.org.ua\/statements\/rekomendatsii-kzhe-shchodo-dotrymannia-zhurnalistskoi-etyky-v-rozdilakh-onlayn-media-shcho-ne-pidliahaiut-redaktsiynomu-kontroliu-blohy-kolonky\/\">Recommendations of the Commission Regarding Observance of Journalistic Ethics in Online Media Sections Not Subject to Editorial Control<\/a>, such media envision clear provisions in the rules for blogs that would regulate the procedure for reviewing complaints, contain a list of prohibited categories of content and actions that can be taken against materials that violate the rules and their authors. When restrictive measures are applied, individuals who are targeted must be provided with the reason for using this measure and with an opportunity to express their opinion to the administration of the platform. The absence of such mechanisms may indicate restrictions on freedom of expression and so-called \u201cprivatized\u201d censorship by administrators or owners of blogging platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Conclusion and recommendations<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In view of the above, the Commission believes that the material by Censor online outlet<em>\u201cLviv oblast military administration has issued hundreds of border crossing permits to \u201cvolunteers\u201d associated with lawyer Shevchuk \u2014 media. Infographic\u201d<\/em>published on June 6, 2023, <strong>does not violate <\/strong>the requirements of the Ethics Code of the Ukrainian Journalist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the Commission urges Censor to note that the disclaimer <em>\u201cThe Censor.NET editorial team does not necessarily agree with the opinion of the authors. Materials in the Blogs section are the sole responsibility of the authors\u201d <\/em>is not sufficient as clear rules for using blogs on the CensorNet.Blogs platform, and that such rules should be developed. They should establish a convenient mechanism for complaining about content that may violate the requirements of journalistic ethics and legislation, provide for the types of prohibited content, as well as measures that can be taken against offending materials and their authors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Commission also calls on Censor.NET and other media to properly reprint, quote or interpret materials from other media. The audience has the right to clearly understand whether such reprinting and quotation is in whole or in part, and whether the quotation is verbatim or an interpretation of certain parts of another outlet\u2019s material. Improper design of reprints or citations may mislead the audience regarding the content of original material and put the reputation of journalists and the media at risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Commission separately emphasizes that the right to apply to the Commission cannot be abused to punish the media or bring them to liability in judicial proceedings. This case, in which the applicant complains not about the original material whose authors requested a comment, but about its reprint, may serve as an example of such an abuse.
